Privacy Policy

Waterskiers World (ACN 010 448 861) is a specialist towed watersports retailer — water skis, wakeboards, wake surfers, life jackets, tubes and accessories — operating from our store at 1106 Ipswich Road, Moorooka QLD 4105, and online at waterskiersworld.com.au. In this policy, "we", "us" and "our" mean Waterskiers World.

We respect your privacy and handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy explains what we collect, why, who we share it with, and how you can access, correct or ask us to delete it.

1. What personal information we collect

We only collect what we need for the reason you're giving it to us. Depending on how you deal with us, this may include:

• Contact details — your name, email address, phone number, and billing and delivery addresses.
• Order details — what you've bought, when, how it was delivered, and any returns, exchanges or store credit.
• Account details — if you create a customer account, the email address you sign in with and your order history. Sign-in uses a one-time code emailed to you; we don't store a password for you.
• Sizing and fit information — things you tell us so we can recommend the right gear, such as your weight, height, boot size, riding ability, or the boat you ride behind. You're never required to give these.
• Warranty, return and demo details — product details, photos and descriptions you send with a warranty claim or return, and details you give us when you take part in our demo program.
• Communications — emails, chat messages, phone calls and reviews you send us.
• Marketing preferences — whether you've subscribed to our emails or SMS, and how you interact with them (for example, whether an email was opened).
• Technical and browsing information — your IP address, device and browser type, pages you view, products you look at, how you arrived at our site, and cookie identifiers. See section 7.

Payment card details: card and account details are entered directly into our payment providers' secure systems (see section 5). We do not see or store your full card number.

You can browse our site and visit our store without giving us your name. If you choose not to provide information we ask for, we may not be able to process an order, a warranty claim or a request.

2. How we collect it

• Directly from you — when you order online, in store or over the phone, create an account, contact us, sign up to emails, submit a warranty or return form, leave a review, or enter a competition.
• Automatically — through cookies and similar technologies when you use our website (section 7).
• From third parties — for example, our payment and buy-now-pay-later providers confirming a payment, delivery carriers updating us on a parcel, and manufacturers or distributors responding to a warranty claim.

3. Why we use it

• To process, deliver and support your orders, including returns, exchanges, store credit and refunds.
• To give you sizing and product advice.
• To manage warranty claims with the relevant manufacturer or distributor.
• To run our demo program.
• To answer your questions and provide customer service.
• To send you marketing, where you've agreed to it (section 6).
• To understand how our website is used and improve it, including measuring which advertising works.
• To prevent fraud and keep our website, systems and customers secure.
• To meet our legal obligations, including tax, consumer law and product safety requirements.

We don't sell your personal information.

4. Product safety and life jackets

Some of what we sell is safety equipment. If a manufacturer issues a recall or safety notice for a product you bought from us, we may use your contact details to tell you — even if you've unsubscribed from marketing. These notices aren't marketing.

5. Who we share it with

We share personal information only where it's needed for the purposes above, with:

• Our e-commerce platform — Shopify, which hosts our online store, customer accounts and order records.
• Payment providers — including Shopify Payments / Shop Pay, Afterpay [and any others offered at checkout — confirm list]. Buy-now-pay-later providers make their own decisions about your application and handle your information under their own privacy policies.
• Delivery carriers — such as Direct Freight Express, Aramex (Fastway) and Australia Post, who receive your name, delivery address and phone number to deliver your order.
• Manufacturers and distributors — when you make a warranty claim, we pass on the details needed to assess it. The manufacturer decides the outcome.
• Email and messaging — Klaviyo, which sends our emails [and SMS — confirm], and Gorgias, which we use for customer service chat and email.
• Reviews, search and video — Stamped (product reviews), Searchanise (site search) and Tolstoy (shoppable video).
• Analytics and advertising — Google (Analytics, Ads, Merchant Center), Meta (Facebook and Instagram), TikTok [and Amplitude — confirm]. See section 7.
• Game hosting — Cloudflare, which hosts our Toon Skiers World game and stores its leaderboard, player profiles and play statistics (section 8).
• Professional advisers and authorities — our accountants, lawyers and insurers, and government or law enforcement bodies where the law requires or allows it.

We require these providers to protect your information and use it only for the service they provide to us.

6. Marketing

We'll only send you marketing emails or SMS if you've subscribed, or if you're an existing customer and the message relates to products like those you've bought. Every marketing email and SMS includes a way to unsubscribe, and we act on unsubscribe requests promptly. You can also contact us (section 14) to opt out.

Creating a customer account, including by logging in to Toon Skiers World, does not subscribe you to marketing.

7. Cookies, analytics and advertising

Cookies are small files stored by your browser. We and our providers use them to:

• Make the site work — your cart, currency, sign-in and checkout (essential; can't be switched off).
• Understand how the site is used — through Google Analytics and similar tools.
• Measure and personalise advertising — through Google Ads, the Meta Pixel and the TikTok Pixel. These tell us whether our ads lead to visits and purchases and may be used to show you our ads on other sites and apps.
• Remember your preferences and support features like reviews, chat and site search.

When you first visit, our cookie banner lets you accept or decline non-essential cookies, and you can change your choice at any time [via the "Cookie preferences" link in the footer — confirm]. You can also block cookies in your browser settings, and manage ad personalisation directly with Google, Meta and TikTok. Blocking some cookies may stop parts of the site from working.

8. Toon Skiers World (our waterski game)

Toon Skiers World is a free waterski game we've built. It's hosted on Cloudflare at play.waterskiersworld.com.au, separately from our store. Toon Skiers World is for players aged 18 and over. You can play without an account.

If you play without logging in:

• Your settings, skier and scores are saved on your own device.
• If you post a score to the worldwide leaderboard, we store the player name you choose, your scores, the ski you used, your device type and a random player identifier created by the game. Your player name and scores are shown publicly, so please use a nickname, not your real name. Player names are filtered for offensive language.

If you log in with your Waterskiers World account (to become a Registered Competitor):

• You sign in on Shopify's own login page. The game never receives your password, email address or name.
• We store your Shopify customer ID together with your player name, how your skier and boat look, your ski graphics, your game settings and your scores. We use these to sync your game across your devices, and to verify leaderboard runs for competitions.
• Your player name and scores are shown publicly on the leaderboard. Your customer ID and the game's player identifier are not shown publicly.
• Logging in links the game's random player identifier on that device to your account.

Play statistics. To help us improve the game, it records how it's used: a random session identifier, the game's random player identifier, your player name, the game version, your device type and operating system, whether the game is installed or you're logged in, your country (worked out from your connection — we don't store your IP address), how long you spend in each part of the game, and the event, length and score of each run you finish. These statistics don't include your real name or email address. Because they include your player identifier, they can be linked to your account if you log in.

You can switch play statistics off at any time in your Skier Profile.

Shared ski designs. If you choose to share a ski sticker design, the design, its name and the author name you give are shown publicly to other players. Please don't use your real name or include personal information in a design. Designs reported by other players are hidden, and we may remove any design.

Competitions. Any competition or prize run through the game will have its own terms, published before it starts.

Keeping and deleting game data. Leaderboard scores, player names and Registered Competitor profiles are kept while the game is running unless you ask us to delete them. Play statistics are deleted after 13 months. To have your leaderboard entries, profile or statistics deleted, contact us (section 14) with your player name and roughly when you played. Data stored only on your own device can be cleared by clearing the game's site data in your browser.

Tapping a product in the game opens its page on our website, where the rest of this policy applies as normal.

9. Automated decisions

Orders placed online may be automatically screened for fraud risk by our e-commerce platform. An order flagged as high risk may be held or cancelled, and we will contact you if this happens. Buy-now-pay-later approvals are decided by the provider, not by us. We don't otherwise use automated systems to make decisions that significantly affect you.

10. Storage, security and overseas disclosure

We store personal information electronically with our service providers, and in limited cases in hard copy at our store. We take reasonable steps to protect it from misuse, loss, and unauthorised access, change or disclosure, including restricting staff access and using providers with strong security.

Several of our providers store information outside Australia. Your information is likely to be held in the United States and Canada, and may also be held in the European Union and other countries where those providers operate. Toon Skiers World data is stored with Cloudflare, which operates a global network and may process it in Australia or overseas. We take reasonable steps to ensure overseas recipients handle it consistently with the Australian Privacy Principles.

If a data breach is likely to cause you serious harm, we'll notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

11. How long we keep it

We keep personal information only for as long as we need it for the purposes in this policy, or as long as the law requires — for example, order and transaction records are kept for at least five years for tax purposes. After that, we delete it or de-identify it. Toon Skiers World data is kept as described in section 8.

12. Children

Our store and Toon Skiers World are intended for adults. If you're under 18, please have a parent or guardian place orders for you, and please don't play Toon Skiers World or log in to it.

We don't knowingly collect personal information from anyone under 18. If we learn that someone under 18 has played the game or created an account through it, we'll delete their game data. A parent or guardian can also ask us to delete it at any time (section 14).

13. Accessing, correcting or deleting your information

You can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. There is no charge to make a request. We'll respond within 30 days. We may need to confirm your identity first, and there are limited cases where the law lets or requires us to refuse — for example, records we must keep for tax. If we refuse, we'll tell you why.

You can also update your account details yourself by signing in to your customer account.

If you have a complaint about how we've handled your information, please contact us first so we can fix it. We'll acknowledge it promptly and aim to resolve it within 30 days. If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

15. Changes to this policy

We may update this policy from time to time, for example when we add new services or the law changes. The current version will always be on this page, with the date it was last updated.
